Terms and Conditions of Use

1. Acceptance of Terms

The use of any service provided by Tesseract implies full acceptance of these Terms and Conditions. If you disagree, you should not use our services.

2. Service Description

Tesseract provides technological services for software development and digital platforms, with PraxSuite being its backend as a service (BaaS) solution, which allows:

• Create and manage custom backends
• Automate workflows
• Manage data securely and scalably
• Integrate with other tools and APIs

The platform is accessible through monthly subscriptions with different levels of functionality.

3. Subscription Model and Payments

PraxSuite operates under a monthly subscription model according to the contracted plan.

• The user is responsible for keeping their payment up to date to access the corresponding functionalities.
• If payment is not made within 10 calendar days following the due date, the account will automatically be downgraded to the free plan, limiting access.
• No refunds are made for periods already elapsed or not used.
• All prices include taxes if applicable according to applicable legislation.

4. Intellectual Property

• The user retains ownership of all data, content, and configurations created within PraxSuite.
• Tesseract and PraxSuite do not claim ownership over user information.
• Notwithstanding the above, the code, design, structure of the platform, and its components are the exclusive property of Tesseract and are protected by copyright and industrial property rights.

5. Privacy and Data Protection

• User information is private and is handled in accordance with our Privacy Policy.
• Tesseract does not access or modify user data without authorization, except when required by law or for technical maintenance.
• We apply technical and organizational measures aligned with international security standards.

6. Refunds and Cancellations

• The user can cancel their subscription at any time from their user panel or by writing to support.
• Access will continue until the end of the already paid period.
• No refunds are made for early cancellations.

7. Service Modifications

Tesseract may modify the services, prices, functionalities, or technical conditions of PraxSuite and other products with reasonable prior notice.

These modifications will be notified by email, user panel, or official website.

8. Acceptable Use

The user agrees to:

• Not use the services for illegal or unauthorized activities.
• Not interfere with or disrupt the system's operation.
• Not attempt to access data or accounts of other users.

Tesseract reserves the right to suspend or cancel accounts that violate these principles.

9. Limitation of Liability

• The use of PraxSuite and Tesseract's services is at the user's sole risk.
• Tesseract is not responsible for indirect damages, loss of profits, or service interruptions.
• In no case will Tesseract's total liability exceed the amount paid by the user in the last 3 months.

10. Support and Availability

• The service includes basic support through enabled channels (email, chat, or others).
• 100% availability is not guaranteed; maintenance windows and improvements apply.
• In case of major failures, Tesseract will inform in a timely manner and act to restore the service.

11. Applicable Law and Jurisdiction

These Terms are governed by Chilean legislation. Any dispute will be resolved by the ordinary courts of justice in the city of Valparaíso, unless otherwise agreed in writing.
